1. Acceptance
By downloading, installing or using FoxDL (the “App”) you agree to these Terms of Use (the “Terms”), which form a binding agreement between you and Banba Games (“we”, “us”). If you do not agree, do not use the App.
These Terms apply alongside Apple’s Licensed Application End User License Agreement. Where they are silent, Apple’s standard EULA applies; where they add to it, these Terms govern.
These Terms are published in other languages for convenience. This English text is the authoritative version; where a translation differs from it, the English text governs.
2. Your licence
We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the App on Apple-branded devices you own or control, as permitted by the App Store Terms of Service and by these Terms.
You may not: copy, sell, rent, sublicense or redistribute the App; reverse-engineer, decompile or disassemble it except to the extent that applicable law expressly permits; remove or alter any proprietary notice; or use the App to build a competing product.
3. The App supplies no content
FoxDL provides, hosts and supplies no content. No channel, film, series, track, episode or stream ships with the App, and we operate no media service of any kind. The App is a player, a file manager and a download client: a tool that opens what you give it.
Everything you see inside the App is something you added — your own files, a playlist or account you subscribed to, or an entry in a public directory that plays from the publisher’s own address.
4. Your content and your responsibility
You are solely responsible for the content you add to the App and for having the right to use it. By using the App you confirm that:
- You own the content, have licensed it, or otherwise have the legal right to play, download and store it.
- Any IPTV playlist, Xtream Codes account, cloud account, server or link you add is one you are legally entitled to access, obtained from a service you legitimately subscribe to.
- You will not use the App to stream, download, copy or distribute copyrighted material without the copyright holder’s permission.
- You will not use the App to access content unlawfully, to circumvent technical protection measures, or in breach of any law that applies to you.
We do not permit the streaming or downloading of copyrighted material without the copyright holder’s permission. We have no visibility into what you add, cannot verify it, and accept no responsibility for it.
5. Third-party services and sources
The App can connect to services operated by other people: IPTV providers, cloud storage providers, WebDAV servers, websites, and the public directories Podcast Index and Radio Browser. We do not control them, do not endorse them and are not responsible for their content, availability, pricing, accuracy or practices. Your use of them is governed by their own terms.
Podcast and radio entries come from those directories and play from the publisher’s or broadcaster’s own address; all rights remain with them. Requests to remove an entry can be sent to the relevant database or to [email protected].
6. Acceptable use
You agree not to: use the App for any unlawful purpose; interfere with or disrupt the App or any server or network it reaches; attempt to gain unauthorised access to any system; use automated means to abuse the free allowances or the advertising in the App; or misrepresent your identity or affiliation.
7. The free version and advertising
The free version is complete but metered: certain actions have an allowance, and going past it may require watching a short rewarded video that you start yourself. There are no full-screen ads in the App, and none may be added. Advertising is supplied by Google AdMob and its mediation partners; what they receive is described in the Privacy Policy.
Allowances, their sizes and the way they are refilled may change between versions.
8. FoxDL Pro subscriptions
FoxDL Pro is an auto-renewing subscription offered on weekly, monthly and yearly terms. The current price and the price per period are shown in the App before you buy, in your own currency.
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews automatically unless auto-renew is turned off at least 24 hours before the end of the current period.
- Your account is charged for the renewal within 24 hours prior to the end of the current period.
- Subscriptions can be managed, and auto-renew turned off, in your Apple Account settings after purchase.
- Where an introductory or free-trial offer applies, any unused portion of a free period is forfeited when you buy a subscription covering the same content.
One subscription covers iPhone, iPad and Mac when signed in with the same Apple Account. Cancelling stops the next renewal; access continues until the end of the period already paid for. Refunds are handled by Apple at reportaproblem.apple.com — we cannot issue them on Apple’s behalf.
Features included in Pro may be added to or changed over time; we will not remove a headline feature you subscribed for without offering an equivalent.
9. Intellectual property
The App, its name, its logo, its interface and its underlying software are owned by Banba Games and protected by copyright and other laws. Nothing in these Terms transfers any of those rights to you. Trademarks belonging to third parties — including Apple, Google, Dropbox, Microsoft and others — are the property of their respective owners and appear only to describe compatibility.
10. Copyright complaints
We take copyright seriously, even though we host nothing. If you believe content is being made available in a way that infringes your rights and is connected to the App, write to [email protected] with:
- Your name, address and contact details, and the rights holder you represent.
- Identification of the protected work concerned.
- Identification of the material complained of and where it can be found — including the service, directory or provider concerned.
- A statement that you believe in good faith that the use is not authorised by the rights holder, its agent or the law.
- A statement, under penalty of perjury where applicable, that the information is accurate and that you are authorised to act.
- Your physical or electronic signature.
Where the material sits with a directory or provider rather than with us, we will tell you who to contact and, where we can, pass the notice on. The App itself contains no content to remove.
11. Apple
You acknowledge that these Terms are concluded between you and Banba Games only, and not with Apple, and that we alone — not Apple — are responsible for the App and its content.
- Apple has no obligation to furnish any maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- We, not Apple, are responsible for addressing any claim relating to the App, including product liability claims, any claim that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that the App infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.
12. Disclaimer
The App is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the maximum extent permitted by law.
We do not warrant that the App will be uninterrupted, error-free or compatible with every device, file, codec, server or provider, or that any third-party service it connects to will remain available.
13. Limitation of liability
To the maximum extent permitted by law, Banba Games shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, files, profits or goodwill, arising out of or in connection with your use of the App — including data lost when an app is deleted, a device is reset, or a third-party service withdraws access.
Our total liability for any claim relating to the App shall not exceed the greater of the amount you paid us for the App in the twelve months preceding the claim, or ten euros.
Nothing in these Terms excludes liability that cannot be excluded under the law that applies to you, including your statutory consumer rights.
14. Indemnity
You agree to indemnify and hold Banba Games harmless from any claim, demand, loss or expense — including reasonable legal fees — arising from content you added to the App, from your breach of these Terms, or from your infringement of the rights of a third party.
15. Termination
You may end this agreement at any time by deleting the App. We may suspend or terminate your licence if you materially breach these Terms. Sections that by their nature should survive termination — including sections 4, 9, 12, 13 and 14 — do so.
16. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules, and the courts of Istanbul shall have jurisdiction. If you are a consumer resident in the European Economic Area, the United Kingdom or another jurisdiction whose law grants you mandatory protections, nothing here deprives you of those protections or of the right to bring proceedings in your local courts.
17. Changes to these Terms
We may update these Terms as the App changes. The date at the top of this page shows the current version, and material changes are surfaced inside the App. Continuing to use the App after a change means you accept it.
